Warranty

This limited warranty is provided by Fotons Lighting Inc. Lighting Manufacturer (“Seller”) to the original purchaser of the LED lighting product that is identified on Seller’s invoice (“Customer”) reflecting its original purchase (the “Product”) in Canada or in USA. Please refer to the product specification sheet for Five (5) YEARS (L70) from the date of original purchase or One (1) YEAR warranty for clearance products.

  1. This Warranty cannot be transferred or re-assigned by the original end user.
  2. The determination of whether the Product is defective shall be made by Seller with consideration given to the overall performance of the Product.
  3. If Seller determines the Product is defective, Seller will elect to repair the Product, replace the Product, or refund at purchase price. The Seller reserves its right to use new, rebuilt, repaired, or refurbished products and parts, which shall prove similar to the original products or parts in terms of functionality and performance, and shall be covered by this Warranty for the remainder of its initial term.
  4. The warranty period applicable to the original Seller Product in question shall continue to apply, such that there shall be no extended warranty period applicable to the replacement item.
  5. This limited warranty is void where a Seller Product has failed to perform in accordance with the Seller. Product Warranty and the failure results from use of the Seller Product in question outside the operating parameters forming part of Seller’s specifications for that Seller Product.
  6. This limited warranty will not apply to loss or damage to the Product caused by: negligence; abuse; misuse; mishandling; improper installation, storage or maintenance; damage due to fire or acts of God; vandalism; civil disturbances; power surges; improper power supply; electrical current fluctuations; corrosive environment installations; induced vibration; harmonic oscillation or resonance associated with movement of air currents around the Product; alteration; accident; failure to follow installation, operating, maintenance or environmental instructions prescribed by Seller or applicable electrical codes; or improper service of the Product performed by someone other than Seller or its authorized service provider.
  7. The Seller’s liability for the defective Product is limited to the amounts paid in order to purchase said Product.
  8. This limited warranty excludes field labour and service charges related to the repair or replacement of the Product.
  9. In order to file a claim, Customer must notify the Seller in writing within fifteen (15) days of the discovery of a defect, provide a valid proof of purchase, and comply with the Seller’s requirements as they are described in this document. Upon receipt of a written notice, the Seller may require that the Product be returned (freight prepaid) in the shortest possible delays, either to the Seller itself or to its authorized service provider.
  10. Items sent back to us without first requesting a return will not be accepted.
  11. This Warranty, as well as any and all legal warranties provided for by the laws of Ontario, are the only warranties You can invoke in connection with the Product.
  12. This Warranty applies only to LED products offered and sold by the Seller. The Seller may amend or otherwise modify the parameters of this Warranty from time to time. Any amendment or modification of this Warranty shall apply to all orders placed with the Seller as from the effective date of the amended or modified version of the Warranty.
